Welcome to LuxAir Freshener LLC ("LuxAir," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of [www.luxairfreshener.com] (the "Site") and any purchases made through the Site.

By accessing the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

1) Eligibility and Account Responsibilities

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase.

If you create an account, you are responsible for maintaining the confidentiality of your login information and for all activity under your account.

2) Products, Pricing, and Availability

We sell air fresheners, car diffusers, and diffuser oil refills and related products (collectively, "Products").

We may change product offerings, descriptions, pricing, or availability at any time without notice. All prices are listed in United States Dollars (USD) unless otherwise stated.

We make every effort to display product information accurately. However, we do not guarantee that product descriptions, scent notes, colors, or images are error-free or that your device’s display will match the product exactly.

3) Orders and Payment

When you place an order, you agree that:

  • You are authorized to use the payment method provided.

  • The billing and shipping information you provide is accurate.

  • You will pay all charges associated with your order, including applicable taxes and shipping.

We reserve the right to refuse, cancel, or limit any order for any reason, including suspected fraud, unauthorized transactions, errors in pricing, or product availability issues.

If we cancel an order after payment has been processed, we will issue a refund to the original payment method.

4) Shipping, Delivery, and Risk of Loss

Risk of loss passes to you once the package is delivered to the carrier, to the extent permitted by law. We are not responsible for delays caused by the carrier, customs processing, weather, or other events outside our control.

International orders

International shipments may be subject to customs fees, import duties, and taxes determined by the destination country. These charges are paid by customer at checkout and are not included in product prices unless explicitly stated.

5) Returns, Refunds, and Exchanges

Returns and refunds are subject to our Shipping and Returns policy, which is incorporated into these Terms by reference.

If you believe your order arrived damaged, defective, or incorrect, contact us within 48 hours of delivery and include your order number and photos.

At this time, exchanges are offered. If exchanges are not offered, eligible returns may be requested and a new order may be placed.

6) Promotions, Discount Codes, and Gift Cards

Promotions and discount codes are subject to additional terms, may have expiration dates, and may be limited to certain products or customers.

Unless otherwise stated:

  • Discount codes cannot be combined.

  • Discount codes are not valid on previous purchases.

  • We may modify or discontinue promotions at any time.

Gift cards, if offered, are non-refundable and cannot be redeemed for cash except where required by law.

LuxAir may offer a subscription or auto-delivery program in the future.

If subscriptions are enabled:

  • You authorize recurring charges based on the frequency you select.

  • You can manage, pause, or cancel your subscription through the subscription portal.

8) Use of the Site

You agree not to:

  • Attempt to interfere with the Site’s security or functionality

If you submit reviews, comments, photos, videos, or other content ("User Content"), you grant LuxAir a non-exclusive, worldwide, royalty-free license to use, display, reproduce, modify, and distribute that content for marketing and business purposes.

You represent that:

  • You own the rights to the content or have permission to share it.

  • Your content does not violate any law or third-party rights.

  • Your content is not misleading, harmful, or offensive.

We may remove User Content at our discretion.

11) Product Safety and Proper Use

Our Products are intended for external use only and should be used as directed.

For safety:

  • Keep Products and oils out of reach of children and pets.

  • Avoid contact with eyes and skin.

  • Do not ingest.

  • Avoid spills. Clean immediately if a spill occurs.

  • Do not place oils directly on finished, plastic, vinyl, or fabric surfaces.

  • Store oils in a cool, dry place away from heat and direct sunlight.

You are responsible for safe and proper use of Products.

12) Disclaimer of Warranties

To the fullest extent permitted by law, the Site and Products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Site will be uninterrupted or error-free.

13) Limitation of Liability

To the fullest extent permitted by law, LuxAir will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or Products.

In no event will LuxAir’s total liability exceed the amount you paid to LuxAir for the product(s) giving rise to the claim, or $100, whichever is greater, unless required otherwise by law.
Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

14) Indemnification

You agree to indemnify and hold harmless LuxAir and its owners, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or Products, your violation of these Terms, or your violation of any rights of a third party.

15) Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to conflict of laws rules.

Any dispute arising under these Terms will be brought in the state or federal courts located in Nassau County, New York, unless otherwise required by law.

In the unlikely event of a dispute arising from your purchase or these Terms, it will be resolved through binding arbitration under the rules of the American Arbitration Association. By choosing arbitration, you agree to forego any jury trial or class action, ensuring a streamlined and discreet resolution in line with LuxAir’s commitment to exceptional service.

We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
